Age Discrimination

Long Beach Age Discrimination Lawyers

Does your employer make jokes about your age, ask when you are going to retire, or remind you that you “should not have to work so hard?” These can all be examples of age discrimination. Other examples include:

Passing up older workers for a promotion due to their age when they are equally or more qualified than their competitors

Laying off older workers before younger ones simply because they should “retire”

Encouraging or forcing older workers to officially retire to make room for younger ones

Assigning older workers less favorable assignments or work shifts

Failing to hire based purely on the fact that the applicant is older (40 or above) than other applicants

Continuously making age-related demeaning remarks or engaging in other derogatory behaviors that create a hostile work environment for the older worker

You can rely on our firm to stand up for your legal rights if you believe you have been unfairly treated or targeted in the workplace because of your age. We are here to support you and the laws that protect your right to work without discrimination or harassment.

Two out of three workers between the age of 45 and 74 have observed or actually experienced age discrimination in the workplace.  Age bias can prevent you from getting hired and may be the reason you are fired.  If you are in the tech or entertainment industry, you may be particularly vulnerable.

Are you feeling pushed out from your current job?  Does management ask when you plan to retire? Are you being given fewer responsibilities?  Are there age related jokes and comments about you or other older workers?  All of these actions can amount to age discrimination. Today, twenty percent of Americans are working past the age of 65.  Many Americans do this to supplement their income, but equally important are less tangible benefits including the ability to remain relevant and maintain a sense of well being.

When companies cut salaries and headcounts, senior leaders are often most at risk. Sometimes, management is willing to sacrifice years of experience in return for cheaper and less experienced workers. If you feel you are being singled out or at risk of termination because of your age, you may be the victim of unlawful age discrimination.

To fight back, you can turn to Andrea Cook & Associates. We have a deep background protecting clients wrongfully terminated or who have suffered other adverse treatment based on being 40 years old or older. What Is Age Discrimination?

Age discrimination, like other forms of discrimination, involves treating those over 40 less favorably than others in the workplace. It is often based on stereotypes that falsely portray older individuals as less able to perform their jobs. This type of discrimination is not founded on merit but on a generality that lumps all older workers into this negative category despite their work histories, skills, talents, or work ethic. The laws regarding age discrimination apply to applicants as well as employees. Aged discrimination can be committed in various ways.

Fortunately, those over 40 are protected by the federal Age Discrimination in Employment Act, known as ADEA.  This law is enforced by the Equal Employment Opportunity Commission.(EEOC)

There are specific laws in California governed by state and sometimes local laws.  The Fair Employment and Housing Act (FEHA) is the California version of the EEOC.

The Federal and State laws apply to every stage and aspect of discrimination in the workplace:

  • Job advertising
  • Interviews
  • Hiring
  • Discipline
  • Compensation
  • Benefits
  • Training
  • Assignments
  • Promotion
  • Demotion
  • Performance reviews
  • Termination
